Brexit and Employment Law
Although it seems likely that the headlines will continue to be dominated by Brexit for some time to come, it is important that businesses do not overlook the various upcoming changes in employment law which will take place in 2019 and beyond. We are expecting 2019 to be a challenging year for HR managers with lots of significant developments to get to grips with.
Taylor Walton’s employment team is committed to assisting its clients with keeping up to date with important developments in employment law. We will be running the following workshops in the coming months:
Workshop 1 – TUPE Update
For businesses who provide services to clients or who are thinking about appointing a service provider to carry out services currently undertaken in-house or changing a current service provider, it is imperative to keep up to date with changes in this difficult and technical area. If these issues are relevant to your business, join us for a question and answer session where we will address the following tricky areas:
• Defeating TUPE by the fragmentation of services;
• Identifying the organised grouping of employees;
• When is the reasons for dismissal the transfer itself?
• Inheriting personal injury liability; and
• Harmonisation of terms and conditions of employment.
Workshop 2 – Employment Status
Many businesses face challenging decisions concerning their workforce models in light of recent decisions concerning the employment status of individuals and HMRC reforms relating to contractors and consultants. The risks of miscategorising staff can be significant and at this workshop, we will be providing guidance and answering your questions about the difficulties businesses face in this area. Topics for discussion will include:
• Clarification of employment status following the recent line of cases concerning staff who have been incorrectly categorised and the Government’s proposals in the Good Work Plan;
• HMRC reforms regarding IR35 companies and off payroll workers; and
• Associated risks and problems.
Workshop 3 – Sexual Harassment in the Workplace
Grievances and claims relating to sexual harassment can be time consuming and costly to deal with. With the aid of practical case studies we will look at this highly topical area and how businesses can better protect themselves from claims. Topics for discussion will include:
• Proposed changes in the area arising from the Government’s response to the Women and Equalities Select Committee report;
• The use of non-disclosure agreements in the workplace, in particular in the context of settlement agreements;and
• Practical steps you can take to better protect the business from claims in this area.
