Parental Responsibility

Our expert team are highly experienced in issues relating to parental responsibility – the package of legal rights, duties, powers, responsibilities and authority which a parent has in relation to a child.

There are a complex set of issues surrounding parental responsibility, which governs decisions relating to a child’s healthcare, schooling, discipline and the provision of a home and protection.

Where the parents of a child are married at the time of birth, both parents automatically have parental responsibility. Where this is not the case, the mother will automatically have parental responsibility, and the father can acquire it through a number of means, as detailed on the attached factsheet.

There is no limit to the number of people that can acquire parental responsibility for a child, and it is possible for those other than the parents, for example grandparents and adoptive parents, to acquire parental responsibility.

The most common queries relating to parental responsibility include those relating to changing the child’s surname, taking the child out of the country for a holiday, choice of schools and medical treatment.
